Sullivan & Cromwell v. Charney: We’re Back
We have returned from the preliminary injunction hearing in Sullivan & Cromwell v. Charney, which ended about an hour ago. We’re back online and in the process of working on a write-up.
There were a bunch of other reporters and bloggers at the hearing. We will add links to their coverage as they become available.
Thus far, the only other blogger or reporter who has posted on the hearing is Lavi Soloway. You can access his coverage here.
We will have something more detailed up shortly, so check back soon. Alas, it will only be text. The paparazzi-style photographs that we took of the lawyers will have to wait until tomorrow, because we forgot some cables at home.
In the meantime, a request for all of you: We’d like a fun name for this legal controversy. We are tired of titling our posts “Sullivan & Cromwell v. Charney” or “Charney v. Sullivan & Cromwell.”

wait - so charney was offered a settlement last week? Did he turn it down or did they withdraw it??
More info please. Based on Lavi's writeup I feel quite hostile to Charney. Its one thing when they were offering him hush money because of allegations of discrimination, but a settlement in exchange for destroying emails and documents that he STOLE from the firm!! That's extortion all right... What else do you have

stole? as opposed to copied to support his lawsuit, knowing that S&C would disregard and violate every discovery obligation to avoid producing damaging documents that prove that, regardless of what ABC's motives are, many S&C partners are openly, hostilely homophobic in clear violation of the firm's policies and the law.

After sitting in court today, I feel sympathetic to Aaron Charney, once again. I got no sense that S&C felt they were the victims of extortion. It sounded to me like they were mainly concerned with protecting their clients information and their reputation. I don't think their desire to settle (now the second time) reflects some kind of desparation about these documents, and I don't think they wanted to settle because they felt their backs were up against the wall re the documents, which, I suppose, is what those quick to call this extortion imply. Both Judge Ramos and Judge Fried ordered the documents to be returned, or handed to the court to be kept under seal, and most of them apparently already have been submitted to the court, returned to S&C, or in the case of e-mail sent home, destroyed. S&C must have known all along that no Judge would let Charney keep documents that belonged to S&C for the duration of the two now-consolidated lawsuits. I think S&C was willing to compensate Charney for what he believes he suffered, and wanted to be sure they got everything back. That's not extortion.
I am going to review my 25 pages of notes now, and post to my blog the whole story later today.
I'll try to occasionally respond to the discussion here, when possible.
