October Term 2007 Clerk Hiring: It's Almost Over (If It Isn't Already)

Supreme Court hallway Above the Law Above the Law Above the Law.JPGThe ranks of the Elect, while small, are constantly expanding. We have some new information about a few more folks hired to serve as Supreme Court law clerks for October Term 2007.

Some of this news isn't truly "new," since the clerks in question were hired a while ago. But it's new to ATL, since it wasn't previously reported in these pages. Anyway, here you go:

1. "I imagine you already know this, but Erin Morrow is the last Roberts hire. She clerked for him briefly on the DC Circuit (with Anton Metlitsky and George Hicks) before he went up to the Supreme Court and got the offer over the summer. She's currently clerking for Wilkinson."

2. "Justice Samuel Alito is done hiring. He did not hire any of the people he recently interviewed. Instead, he hired two more former clerks of his (from his Third Circuit days). Alito is turning himself into one of the biggest feeder judges of the past ten years -- after the fact!"

3. "Justice Souter has hired Bert Huang (HLS 2003/Boudin) and Micah Smith (HLS 2006/Calabresi) for OT 2007. Don't know if he's hired the other two."

4. "Don't know which justice, but Mike Mongan (Stanford 2005 / Garland) has been hired for OT 2007. I think it's either Breyer or Souter."

5. "Here's an OT 2008 hire for you: Matt Price (HLS 06, Boudin), by Justice Breyer."

Do you know which justice Michael Mongan is clerking for? Do you know which ex-Alito clerks will be reunited with their erstwhile boss?

Do you see any other errors or omissions in the information appearing above? If so, please email us. Thanks!

(After the jump, an updated tally of Supreme Court clerks for next Term, reflecting these latest additions.)

It sounds like Leslie Kendrick (Virginia '06 / Sentelle) is another Souter clerk.

what's the story on the people who are 2001 or 2003 grads? did they interview before and not get it? Wait a few years to clerk in the first place? (not talking about the Alito one, I know the story with that)

And Karen Dunn for Breyer. Lat, you're waaay behind Wikipedia. I added Kendrick, who is a WILKINSON clerk, over a week ago.

Rumor has it that a Boies Schiller associate has one of the spots.

Cardozo Law School really sticks out among the school lists, doesn't it? Just an example of Stevens' quirkiness? Or does Cardozo have a history of Supreme Court clerkships?

SOC is not retired!!!! She's only taken senior status. Will she have to put out an announcement like Judge Silberman did? See http://legaltimes.typepad.com/blt/2007/03/silbermans_stat.html

Mongan's also SLS '06, no '05.

Cardozo has had only one other Supreme Court clerk, Cliff Elgarten, from Cardozo's initial class of 1979, who clerked for Brennan. But he and Sara Klein will not be the last, I hope.

wait, the other Cardozo clerk was from the first year the school existed? How on earth did he pull that off?

Anonymous is right on both counts re: Mongan

If SOC sends out that announcement, she'll need to send it to the Court's PR office, first, because it describes her as "retired":

http://www.supremecourtus.gov/about/biographiescurrent.pdf

Right after that, she should send a copy to whoever authored her retirement letter:

http://www.cnn.com/2005/LAW/07/01/oconnor.letter.nobanner/

Other than that, though, I completely agree with you.

I understand that the '01 grad for Thomas practiced for a couple years, then clerked on the DC Cir., then interviewed with Thomas, and got one of Thomas's typical year or two from now offers.

3:29 - I know Bert Huang (HLS '03)--who was HLR president his 3L year--finished another degree (I believe a phd, also at Harvard) before taking his first clerkship. That explains the time-lag for him.

Phillipa Scarlett, an associate in the Boies Schiller DC office, will be clerking for Justice Breyer

Actually, Leslie Kendrick currently clerks for Judge Wilkinson, not Sentelle.

Bert Huang is awesome! Profile, please!

With respect to the first Cardozo clerk, Cliff Elgarten, I have no personal knowledge of how he managed to get that clerkship. But I have spoken with someone with more knowledge than I and was told that he had "conndections" with Justice Brennan. I'm not sure what that means, but it certainly isn't unusual. It's only unusual in that he came from Cardozo instead of Harvard.

Yale? Bah! James Hunter and Geoff Michael are not just mere "Yalies," but they also attended the prestigious and more important Episcopal Academy, near Phildelphia.
