Brokeback Lawfirm: A Portrait of Gera Grinberg As A Young Man
We realize that not everyone has been following Charney v. Sullivan & Cromwell, the salacious case filed by former S&C associate Aaron Charney (at right), alleging anti-gay discrimination and retaliation by his extremely prestigious (and profitable) former firm. But for those of you who are interested in this matter, today we have a special treat.
Remember Gera Grinberg -- the former colleague of Aaron Charney who some partners suspected was in an "unnatural relationship" with Charney? Grinberg, who no longer works at S&C, is a critical figure in this case. But he has been an elusive figure to followers of this litigation. We've seen no pictures, and we know few facts about him.
Finally, after months of mystery, we've gotten our hands on a photograph of him. It's kinda old, but hey, it's better than nothing.

So here it is -- a picture of Gera Grinberg in the eleventh grade, straight from his high school yearbook (1990):

So whaddya think? Would Gera and Aaron make a cute couple, or what?
Does he look a trifle dorky? Perhaps. But in Gera Grinberg's defense:
1. He's Canadian.2. This photo is over 17 years old. You can't make judgments about how Gera Grinberg looks today based on this pic.
3. Let he who wasn't dorky in high school cast the first stone. And since we're mostly lawyers here, we doubt many stones will be flying.
We thank the source who sent us this photo (and apologize for that crack about Canadians). This pic may be old, but information about Gera Grinberg is hard to come by. We're tremendously grateful!

Charney is learning about the transaction costs of litigation - the thing which, in certain situations, makes litigation among the dumbest thing one can do.
What are the transaction costs here?
1. Damage to his reputation. Had he not started this mess he could have easily gotten another job, now he's un-hirable. Even more so than me.
2. Loss of income. This case will drag out for years. How is Charney supporting himself during that time period? How much money could he have earned by working?
3. Stress. Sullivan & Cromwell is not going to roll over for him. They're going to fight him tooth and nail and this will get as ugly for him as he is making it for them.
4. The damage to the career of his friend Grinberg.
What sort of judgment is worth all this? An implausible one. Unless S&C commits malpractice in jury selection, there is no chance a jury of hard boiled New Yorkers will award him millions for his grievances. Unfortunately, people use the terms Charney complained of every day in New York.
