Wherein Judge Milian Dispels the Stereotype of the Feisty Latina
This short video clip requires little introduction. Res ipsa loquitur. Just watch Judge Marilyn Milian, of The People's Court, benchslap a cute-but-insolent 2L from the University of Miami:

That's her RULING!
I think he only felt he could get away with that because he knew he was talking to a "TV judge" rather than a real judge. And I think she sensed that too, which is why she got so pissed off.
Posted by: Anonymous | October 16, 2007 12:59 PM
so are people's court rulings binding precedent?
Posted by: Anonymous | October 16, 2007 01:00 PM
Anyone know where I can get a clip of the full hearing?
Posted by: Anonymous | October 16, 2007 01:01 PM
What "next forum"? It's the People's Court. Isn't being the judge on this travesty a major embarrassment in itself? And isn't screaming and running away at the commercial pretty poor conduct, or at least it would be in a non-trash-TV court?
Posted by: anon 3L | October 16, 2007 01:02 PM
It's binding arbitration for the most part. Pretty rock solid and nearly impossible to overturn, even if they get the law completely wrong.
Posted by: Anonymous | October 16, 2007 01:03 PM
The whole tone is disrespectful and just dumb- constantly interrupting, and you've got to roll with what the judge gives you. You're not going to beat a judge who says "That's not x." by saying "that's not?" with a sarcastic hypothetical. Any judge in the country would slap this guy around.
I did find the line about how if ANYBODY would take it seriously, it would be a 2L at MIAMI, kind of funny, as though 2L at Miami is the highest peak of the legal profession.
All that aside I am so hot for Judge Milian right now.

God, I loved this. Sure, this was the People's Court, but the guy had it coming. As someone said before, this is too many law students in this country that think they know it all. Isn't the first thing in Civil Procedure that they teach you, even before the actual "law", is to never talk over the person holding the gavel?
Posted by: Anonymous | October 16, 2007 01:19 PM
She's a pissed off Judge (and rightly so). How does that play into the stereotype of the so-called "fiesty latina"? So latina judges have to take shit and be calm lest they play into the stereotype? Dumb headline, Lat. I expect more from you.

In all candor, if the guy says, "There's an application process of some sort". Isn't that putting the other party on notice that, um, there's an application that needs to be filled out ... which will be reviewed by someone ... and that someone will render a decision on whether to accept or deny an application? I would have decided in favor of this guy, but that's my opinion.
There's another clip of this judge on youtube benchslapping an attorney who objected when the judge called him "Honey".
Posted by: Anonymous | October 16, 2007 01:35 PM
A judge says, "you're dead wrong," and he replies with "that's your opinion." Nice tactic. I wonder how well that would play in other situations:
"You're getting a D on this paper."
"That's your opinion."
"I'm sorry be we can't extend you a permanent offer."
"That's your opinion."
"Unfortunately, your score was not sufficient to pass the Florida Bar."
"That's your opinion."
"We are holding you in contempt of court."
"That's your opinion."
"You gon' be my bitch now."
"That's your opinion."
Posted by: Anonymous | October 16, 2007 01:35 PM

What an arrogant little prick. Dude looked like he was gonna cry at the end.
And I'd totally hit Judge Milan...
Ahem... anyway, does this raise C&F issues for Mr. Miami 2L's bar application? To wit: does being disrespectful to a TV judge and being publicly censured by said TV judge for said disrespect (and continuing to be disrespectful in the middle of the censure) constitute a character issue? If he's not going to treat a TV judge with disrespect, what's he going to do when he's a lawyer?
I mean, WTF, man - if he did that to a non-TV judge, he would be on his way to the county slammer to serve a 30-day contempt sentence.
Posted by: PWN3D | October 16, 2007 01:38 PM
Does an "application" to UM's law school just mean you show up, sign your name, and you get accepted? Maybe that caused the judge's confusion.

Tempest in a teapot.
Trash TV contestent -- excuse me, "litigant" - tells off trash TV hostess -- excuse me, "judge" -- and the fake judge loses her temper. If this stirs your emotions, you might want to check out professional "wrestling" for some truly epic battles between good and evil.
If people on Court TV behaved like real lawyers and real judges, they wouldn't put them on TV. This is "entertainment," not reality, and it doesn't tell us much about how these people would behave in their real-life roles. The kid acts like a spoiled brat, and the "judge" acts like an intemperate hothead. Its a close call, but I would say the "judge" is a bit ickier, since she actually used to be a judge before she became an entertainer.

Because I sure as hell think she's an embarrassment to Miami and Georgetown. Then again, my law school has Ann Coulter, so I guess I should apologize, too. Sorry.

this event actually took place several months ago and the kid prayed to God (a.ka. Merv Griffin) that this would never ever see the light of day.
prayer for relief denied. cert denied.
im pretty sure these TV judge shows are basically binding arbitration deals. it is unclear who has appellate jurisdiction over such shows but presumably you argue in front of an en banc panel with Alton Brown, that obnoxious british chef guy, Tom Skerrit, and Chuck Woolery. dunno about choice of law provisions.
all kidding aside, we are all seriously pissed.

"Correct me if Im wrong, but don't these TV court shows actually pay for all of the costs handed down by the judges?"
Pretty much. Each party gets an "appearance fee," and if they lose, the judgment is taken from their fee.

God I hope he can find a way to sue her for baselessly damaging his reputation, for ratings. Unfortunately she probably covered herself with releases before abusing the poor guy.
Posted by: anon | October 16, 2007 03:51 PM
The only thing I disrespect in that poor guy is his inability to stand up for himself. Things I would have said if I were him:
1. You bring shame to UM.
2. You're a baby, a very loud one who is drunk with power.
3. You're selling out the integrity of our profession for money and ratings.
Posted by: anon | October 16, 2007 03:58 PM
3:51 - that's an excellent point. If she's not acting as a real judge, she's probably not entitled to any sort of judicial immunity. I'm sure the poor guy had to sign a release - but if the premise of the show is that it will loosely follow the law, and she throws the law out the window and then damages his reputation to improve her ratings - I'd say he's got enough of a claim to overcome the waiver. I doubt the waiver covered the conflict of interest between a litigant and the judge arising out of the judge's conflict of interest.

Experienced, successful trial attorneys interrupt and talk over judges ALL the time. I've seen it happen consistently, even in high-profile trials. Law schools teach this wrong.
Posted by: Anonymous | October 16, 2007 10:13 PM
I'm sorry, but she was simply out of control. It seems that if a comment like 'that's your opinion' can push you over the edge like that, you might need some help. Seriously.
It's all about putting on a show, well hopefully so in her case. It's kind of ironic how she goes on to say he's embarrassing UM. What is her explosive behavior doing, and she was a teacher? Irony at it's best in my opinion.
Posted by: violet1976 | October 16, 2007 10:29 PM
Keep in mind that we don't know what the show's producers told this guy beforehand. He may have been instructed to be aggressive just so they could get that moment on tape -- "reality" shows are like that.

Posted by: Anonymous | October 17, 2007 09:45 AM
10:34 - right on. This isn't a court, its a reality show. Reality shows are fake. They pump people up, tell them to be emotional, anything to get something interestng to happen. They might very well have told the guy to be aggressive. Anyone who thinks this is real is kidding themselves.
Posted by: mmmm....burger | October 17, 2007 10:16 AM
reality shows ARE fake. however, there is some semblance of real life and behaviour in their format. quite simply, the judge behaved like the (white) trash she is, thinking she was soooo clever, and that it was her right to spout off like that. way overboard with her tirade---maintaining dignity and composure applies doubly to her.
yeah, i would spray spunk all over her face, too---skunk spunk.

The defendant/appellant 2L, however, has vowed to take the case all the way up to the Supreme People's Court in Hollywood. Asked for comment on the decision handed down today by the three judge panel consisting of Judges Judy Scheindlin and Joe Brown and Senior Judge Wapner, the appellant 2L responded, "well, that's just like their opinion...they're totally full of sh-t."

First Rule you learn in Law School is that a lawyer that represents himself in court has a fool for a client. Second Rule is that in such a forum or if you go into small claims court on your own behalf, NEVER tell the judge you've studied law. Because then the judge will think of the First Rule and treat you accordingly.

The first rule I learned in law school was 12(b)(6) failure to state a claim upon which relief may be granted

She's a cute hollywood actress, even if she has been an attorney and a judge. The Peoples Court show is hogwash. Some of the plaintiffs/defendants have to be coached on what to say. Our legal system has its faults, absolutely! But, if court judges really acted like her, crimes would greatly increase in frequency. And, I wouldn't want to be an attorney or a judge. Life is too valuable.
