Lawyer of the Day: Carl Stanley McGee

A top official in the [Gov. Deval] Patrick administration has been placed on unpaid leave because he was arrested in Florida and charged with sexually assaulting a 15-year-old male in a steam room at a $500-a-night Gulf Coast resort.

Carl Stanley McGee, 38, assistant secretary for policy and planning, is scheduled to be arraigned next week for sexual battery in Lee County, Fla.... According to police reports, McGee was arrested Dec. 28 and accused of performing oral sex on the 15-year-old, who was a guest at The Gasparilla Inn & Club, a 95-year-old hotel and championship golf course in Boca Grande.

As they like to say up in Massachusetts, "Thar he blows."

McGee, a former Rhodes scholar and Harvard Law School graduate, was previously a corporate lawyer at the law firm WilmerHale. He was instrumental in the movement seeking to defeat efforts to overturn legalization of same-sex marriage, serving as director of the civic and business outreach efforts of the advocacy group MassEquality.

A year after same-sex marriage became legal in Massachusetts in May 2004, McGee's wedding to John Finley IV was highlighted in the "Vows" section of The New York Times....

Known for his shock of platinum hair, McGee was named one of The Boston Globe's 25 most stylish Bostonians in November. In the article, he described his style as "traditional, but it's also subversive and ironic."

"Traditional," but "subversive." Sort of like married men engaging in steam-room hook-ups?

Good thing Carl McGee isn't running for office. We're reminded of the famous quotation by former Louisiana governor Edwin Edwards, who once boasted that he couldn't lose an upcoming election unless he was "caught in bed with a dead girl or a live boy."

Update: Just a reminder that these are obviously mere allegations. Sources mentioned in the Globe article said they "were stunned by the news of McGee's arrest and said they do not believe the charges." One colleague of McGee told the paper, "I know it didn't happen."

Further Update: Best comment thus far, from an observant, Spanish-speaking reader: "He was arrested for blowing a 15 year old in... huhuhuh... Boca Grande..."

Uhh, I don't think the issue is with him being married. Rather, the issue is that his paramour is 15 years old.

The fact that the kid was 15 and male has a lot to do with it. I recall when a certain celebrity made a video many years ago (a VHS kind of video) with 16 year old girls.

Considering that involved said actor penetrating those girls, whereas this act was receptive, I feel like there's definitely a case for lenient sentencing, and possibly an argument about how criminal can this act be...

Perhaps statutory rape should have coercion proved as an element?

1:46 - coercion as an element would completely undermine the whole concept of statutory rape - namely that the law establishes that if you are under X years of age, you cannot give consent. To say that you can give consent unless you are coerced makes no sense.

Is that a bigger or smaller bandwagon than the one celebrating the irony of conservative politicos (e.g., Larry Craig and Mark Foley) being involved in sexual misconduct?

Democrat or Republican, gay or straight, there just seem to be so many examples of politicians involved in various kinds of sex-related misconduct. Without thinking too hard, the following immediately spring to mind -- Bob Packwood (sexual harassment of multiple women), Bill Clinton (ditto), Barney Frank (lived with a male prostitute), Jim McGreevey (put his secret lover on the state payroll), Gavin Newsome (affair with his staffer's wife), Mark Foley (naughty IMs and emails to teenage pages), and last but not least, Larry "wide-stance" Craig.

And yes, you have a point - the media crucifies as "hypocrites" people like Foley & Craig, while largely allowing Jim McGreevey to get away with outing himself as "a proud gay American" or some such pius nonsense, without looking too closely at the fact that he didnt just cheat on his wife with a man, but he installed that (completely unqualfied) man on the state payroll in a high position, thereby misusing public funds to pay his lover.

The counterexample of course is Bill Clinton - as I recall, his various sexual transgressions, proven or alleged, received a good deal of media coverage.

The real legal issue here is that the age of consent in Florida is 18, so Stan McGee is "into" that crime by 3 years. Whether or not the 15 year old "wanted it" the State of Florida deems that he would have to wait 3 years to be recognized as knowing he did.

Most of the comments on this site about this incident are hideous. Every single one of you who think this is a laughing matter and who downplay the adult abusing the 15 year old because he "was horny" etc. Take a step back and imagine if this was your 15 year old son. This man has abused the trust of a boy and many of you think it is a riot and something to joke about. Maybe this kid hasn't figured his sexuality out yet and this bastard, who is supposedly committed to another person, has used him just to get a little pleasure far from home. The mental affect that may have on the kid could be significant. And any way you look at it, an adult screwing around with a kid (yes, 15 is still a kid) is an abuse of power and a crime. McGee has been charged with sexual battery of a minor. It is not only an inaccurage description to infer to the victim as a "paramour" it is crass, in violation of this child's civil and human rights.
