Lawyer of the Day: Carl Stanley McGee
The day is still young, but we already have our Lawyer of the Day -- and we doubt that anyone we hear about later today can steal this honor away from him. Via the Boston Globe:
A top official in the [Gov. Deval] Patrick administration has been placed on unpaid leave because he was arrested in Florida and charged with sexually assaulting a 15-year-old male in a steam room at a $500-a-night Gulf Coast resort.Carl Stanley McGee, 38, assistant secretary for policy and planning, is scheduled to be arraigned next week for sexual battery in Lee County, Fla.... According to police reports, McGee was arrested Dec. 28 and accused of performing oral sex on the 15-year-old, who was a guest at The Gasparilla Inn & Club, a 95-year-old hotel and championship golf course in Boca Grande.
As they like to say up in Massachusetts, "Thar he blows."
McGee, a former Rhodes scholar and Harvard Law School graduate, was previously a corporate lawyer at the law firm WilmerHale. He was instrumental in the movement seeking to defeat efforts to overturn legalization of same-sex marriage, serving as director of the civic and business outreach efforts of the advocacy group MassEquality.A year after same-sex marriage became legal in Massachusetts in May 2004, McGee's wedding to John Finley IV was highlighted in the "Vows" section of The New York Times....
Known for his shock of platinum hair, McGee was named one of The Boston Globe's 25 most stylish Bostonians in November. In the article, he described his style as "traditional, but it's also subversive and ironic."
"Traditional," but "subversive." Sort of like married men engaging in steam-room hook-ups?
Good thing Carl McGee isn't running for office. We're reminded of the famous quotation by former Louisiana governor Edwin Edwards, who once boasted that he couldn't lose an upcoming election unless he was "caught in bed with a dead girl or a live boy."
Update: Just a reminder that these are obviously mere allegations. Sources mentioned in the Globe article said they "were stunned by the news of McGee's arrest and said they do not believe the charges." One colleague of McGee told the paper, "I know it didn't happen."
Further Update: Best comment thus far, from an observant, Spanish-speaking reader: "He was arrested for blowing a 15 year old in... huhuhuh... Boca Grande..."

Uhh, I don't think the issue is with him being married. Rather, the issue is that his paramour is 15 years old.

sounds like he'd have fit in better with the former governor of america's armpit, new jersey.

This story is wrong on so many levels.

I knew him at Wilmer, and he never even once propositioned me. What a d-bag!

15 is wrong whether gay or straight.

Guys at my high school used to give bjs to 15-year-old boys in the steamroom all the time; it was no big deal.

I think you mean "not running" for office.

Yikes. That kind of assault on a kid should get you locked up for a long time. Let's hope that Limbaugh and friends don't read this as a problem with gays in general.
Posted by: Anonymous | February 7, 2008 11:36 AM
Actually for me it reads: "Good thing Carl McGee isn't running for office."
Posted by: Anonymous | February 7, 2008 11:38 AM
Too bad he wasn't in Dade County, FL. He'd probably never been arrested.

Yet again, a ghey proves that gheys are destroying this country.

What was his sport? Or was he one of the "leadership" Rhodes?
Posted by: anon | February 7, 2008 11:46 AM
So what's the 15 year old's complaint?
Posted by: Anonymous | February 7, 2008 11:47 AM
When I was at HLS guys I knew used to give head to 15 year old boys in discreet locations all the time. It was no big deal.
Posted by: T1 Stud | February 7, 2008 11:48 AM
Back at my TTT school, guys used to give head to 15 year old boys in the library all the time. Then the law students would kick the crap out of those pedophiles and send them to HLS. It was no big deal.

Do the men here remember how horny they were at 15?
If the boy was conscious of what was going on and consented, there's no harm here, except to this man's reputation.
Posted by: Anonymous | February 7, 2008 12:17 PM
By the way, I'm a proud member of NAMBLA.
Posted by: 12:17 | February 7, 2008 12:23 PM
12:17, I think that's the problem. A 15-year-old probably can't legally consent. Plus there's the issue of this being somewhat public.
Posted by: Anonymous | February 7, 2008 12:24 PM
Well, in pro wrestling, platinum blonde hair is the sign of a bad guy, so why not in the legal profession.
Posted by: Anonymous | February 7, 2008 12:29 PM
Really, I've got my NAMBLA card in my pocket right now. Why don't you reach in and pull it out...

This guy is a disgrace to the institution of gay marriage.
Posted by: anons | February 7, 2008 12:36 PM
"the movement seeking to defeat efforts to overturn legalization of same-sex marriage"
fairly awkward phrase... takes a few seconds to see if he was working for or against gay marriage
Posted by: Anonymous | February 7, 2008 12:38 PM
12:38 - agreed. why do lawyers have such difficulty speaking clearly?
Posted by: Anonymous | February 7, 2008 12:45 PM
I was sort of scared of Max Headroom as a kid. That picture is making me uneasy.

And so starts anew the media and celebrity bandwagon celebrating the irony of liberal politicos being involved in sexual misconduct.
Posted by: Anonymous | February 7, 2008 01:15 PM
Does this offeset Ted Haggard (and his numerous fellow travelers)?
Posted by: Anonymous | February 7, 2008 01:15 PM
He was arrested for blowing a 15 year old in.. huhuhuhuh Boca Grande... huhuhuh
Posted by: Beavis | February 7, 2008 01:42 PM
@11:27 et al.
The fact that the kid was 15 and male has a lot to do with it. I recall when a certain celebrity made a video many years ago (a VHS kind of video) with 16 year old girls.
Considering that involved said actor penetrating those girls, whereas this act was receptive, I feel like there's definitely a case for lenient sentencing, and possibly an argument about how criminal can this act be...
Perhaps statutory rape should have coercion proved as an element?
Posted by: Anonymous | February 7, 2008 01:46 PM
1:46 - coercion as an element would completely undermine the whole concept of statutory rape - namely that the law establishes that if you are under X years of age, you cannot give consent. To say that you can give consent unless you are coerced makes no sense.

What's wrong with giving a little oral to a 15 year old? Personally I prefer Senior Citizens but young folks need love too.

Guy defending gay marriage gets exposed as a paedofile.
Not a good look for the gay movement, is it?
Posted by: Eeeeewwww | February 7, 2008 03:02 PM
"And so starts anew the media and celebrity bandwagon celebrating the irony of liberal politicos being involved in sexual misconduct."
Is that a bigger or smaller bandwagon than the one celebrating the irony of conservative politicos (e.g., Larry Craig and Mark Foley) being involved in sexual misconduct?
Democrat or Republican, gay or straight, there just seem to be so many examples of politicians involved in various kinds of sex-related misconduct. Without thinking too hard, the following immediately spring to mind -- Bob Packwood (sexual harassment of multiple women), Bill Clinton (ditto), Barney Frank (lived with a male prostitute), Jim McGreevey (put his secret lover on the state payroll), Gavin Newsome (affair with his staffer's wife), Mark Foley (naughty IMs and emails to teenage pages), and last but not least, Larry "wide-stance" Craig.
Posted by: Anonymous | February 7, 2008 03:19 PM
3:19 -- thanks for taking the bait. To answer your question... it's a smaller bandwagon, because many people tout the Packwood/Foley/Craig examples, and pretend the others didn't happen.
Posted by: 1:15 | February 7, 2008 03:45 PM
Ah, yes, 1:15/3:45. The Bill Clinton-Monica Lewinsky story was sadly underplayed.
Posted by: Anon | February 7, 2008 04:22 PM
1:15 -- thank YOU for offerring the bait, it was quite delicious.
And yes, you have a point - the media crucifies as "hypocrites" people like Foley & Craig, while largely allowing Jim McGreevey to get away with outing himself as "a proud gay American" or some such pius nonsense, without looking too closely at the fact that he didnt just cheat on his wife with a man, but he installed that (completely unqualfied) man on the state payroll in a high position, thereby misusing public funds to pay his lover.
The counterexample of course is Bill Clinton - as I recall, his various sexual transgressions, proven or alleged, received a good deal of media coverage.

Rob Lowe got caught with that 16-year-old 20 years ago. It was a completely different era. Back then "To Catch a Predator" wasn't on tv and teachers weren't getting caught boinking their students every week. If this were to happen today, trust that he would be getting prosecuted. See R. Kelly.

Monica Lewisnski, yes, but don't forget Jennifer Flowers, Kathleen Willey, Juanita Broaddrick, and the various stories about the Arkansas troopers.

Yes, really
pious (adj.)

3. seemingly virtuous; affecting virtue hypocritcally

3:19 - you forgot David Vitter banging whores
Posted by: Anonymous | February 7, 2008 09:45 PM
Wow, a pervert from Massachusetts, who would have ever guessed.
Posted by: Jim | February 7, 2008 10:45 PM
If it wasn't for Massachusetts, we'd all still be living in British colonies. Massachusetts DRAGGED the other colonies into the war. And we were right!
That being said, here's hoping McGee gets the full-on Raggett treatment during his long prison stay.

The real legal issue here is that the age of consent in Florida is 18, so Stan McGee is "into" that crime by 3 years. Whether or not the 15 year old "wanted it" the State of Florida deems that he would have to wait 3 years to be recognized as knowing he did.
Posted by: AgeOfConsent | February 8, 2008 05:36 PM
Most of the comments on this site about this incident are hideous. Every single one of you who think this is a laughing matter and who downplay the adult abusing the 15 year old because he "was horny" etc. Take a step back and imagine if this was your 15 year old son. This man has abused the trust of a boy and many of you think it is a riot and something to joke about. Maybe this kid hasn't figured his sexuality out yet and this bastard, who is supposedly committed to another person, has used him just to get a little pleasure far from home. The mental affect that may have on the kid could be significant. And any way you look at it, an adult screwing around with a kid (yes, 15 is still a kid) is an abuse of power and a crime. It is shameful what many of you are writing - you all need to grow up. And those of you who are Democrats - if you don't condemn this sort of thing, you set yourselves up for well-deserved criticism of having absolutely no standards of conduct at all.

Let's not forget another little-played story: that of Charles Rust-Tierney, head of the Virginia chapter of the ACLU and advocate of unrestricted access to pornography in libraries. He got seven years in prison for his sicko pics and vids of little (infant and toddler up to pre-pubescent) girls being raped while they screamed. Anyone care to guess his political affiliations? (Hint: he wasn't a Republican...)
Posted by: Tickler | February 9, 2008 01:20 AM
HOLY SHIT. This is so fucked up that it's actually plausible to think this whole thing was a set-up by conservative christians to fuel further public hatred of homos.
Sad thing, it's probably not. This guy is perhaps the smartest and most prestigious homo in the country, he's like the gay equivelant of Martin Luther King, and now his ass just got caught doing the worst possible thing, in terms of furthering the viewpoint of those who see homosexuals as disgusting and deviant.
This guy spent most of his time trying to further gay rights, too bad he's just set them back more than anything. Sad.

A lot of collectivist BS here. One gay man commits a crime and suddenly it's supposed to have implications for all gay men.

"A lot of collectivist[sic] BS here. One Christian Republican man commits a crime and suddenly it's supposed to have implications for all Christian Republican men."
fixt.
A hypocrite is not someone who advises others to hew to a moral code he believes in but fails to live up to due to weakness (e.g. David Vitter & his hookers).
A hypocrite is someone who advises others to behave in a way she has no intention of doing herself (e.g. Laurie David's private jetsetting to global warming hoax-fests).

Imagine if Martin Luther King got caught molesting a 15 year old girl. That would have destroyed the image of black people.
This guy has done the exact same thing for gays. This is not just some gay dude. This is symbolic of gays in general. If this Harvard-educated Rhodes scholar can't control himself, then gays are finished.

McGee has been charged with sexual battery of a minor. It is not only an inaccurage description to infer to the victim as a "paramour" it is crass, in violation of this child's civil and human rights.
