How fucking stupid do you have to be to brag about having someone who was possibly underage (as far as he knew; she's 22 now, he knows when the movie was made) in pornography?

I love it. I hate skeezy Joe Francis. Seriously, they couldn't take 5 SECONDS to the math to realize she was underage before announcing they already had pictures of her. From the second that they said "we have pictures of her from 5 years ago" I wondered if they meant late 2003, b/c otherwise she would be underage.

Lat - the story about Dupre's age came out several days ago. What took you so long to get it up. If you read the story carefully you'll also discover that Buchwald says she "may have been 17" when Francis shot the photos, not that she was. I'm not sure why he's equivocating on the ssue, but he's less certain of her age than you are.

I am actually not a law student but here is a point. Dupre still signed the contract. Just because you are underage does not invalidate the contract. It just means she can invalidate it when she turns 18. She did not. By waiting until after 18, and not diss-affirming the contract she has affirmed it. Lets not forget law school. Therefore, he still owns the rights to it. But then . . . child pornography laws.

You are arguing capacity to contract when Frances put a 17 year-old girl in pornography, which is a violation of 18 USCS 2251 (a). There is no "knowingly" in that provision for minor's age, only for interstate commerce, which certianly applies to Girls Gone Wild:

" Any person who employs, uses, persuades, induces, entices, or coerces any minor to engage in, or who has a minor assist any other person to engage in, or who transports any minor in interstate or foreign commerce, or in any Territory or Possession of the United States, with the intent that such minor engage in, any sexually explicit conduct for the purpose of producing any visual depiction of such conduct, shall be punished as provided under subsection (e), if such person knows or has reason to know that such visual depiction will be transported in interstate or foreign commerce or mailed, if that visual depiction was produced using materials that have been mailed, shipped, or transported in interstate or foreign commerce by any means, including by computer, or if such visual depiction has actually been transported in interstate or foreign commerce or mailed."

Penalty under (e):

Any individual who violates, or attempts or conspires to violate, this section shall be fined under this title and imprisoned not less than 15 years nor more than 30 years
