Nationwide Layoff Watch: Thacher Proffitt Follow-Up

In the meantime, we have some news about Thacher Proffitt & Wood. The firm's official position is that they haven't laid off anyone; they've simply had lots of voluntary departures, some spurred by buyout offers. But that position seems harder and harder to maintain, in light of what we've been hearing. Even if there might be a difference in form, there isn't much of a difference in substance between (1) getting laid off and (2) taking a buyout and/or leaving the firm, after being told that if you stay, you'll be laid off.

Here are the latest things we've been hearing about TPW:

1. "[A] large part, if not all, of the people who had taken the buyout in NY, but were still staying on until May, were told to leave on Friday (buyout still intact)."

2. "Thacher is pushing harder for people to leave. Associates, especially the young ones, that were guaranteed steady work (and jobs) when this first broke last fall have been consistently billing less than 100 hours (as low as 50 hours) per month since. The slowdown is worse than the partners had initially anticipated."

3. "About another 40 laid off and partner Ollie Armas has left with the entire Mexico City Office."

We presented the foregoing information to the firm, which responded as follows:

To reiterate our recent statement, Thacher Proffitt has increased our efforts to provide associates with outplacement in practice areas that have been most affected by current market conditions. Other areas, such as litigation, bankruptcy and banking are very busy.

Update: Although Ollie Armas still appears on the TPW website, we've confirmed that he and an unspecified number of other TPW lawyers in Mexico City are moving over to Chadbourne & Parke.

Further Update: Perhaps the Mexico City group was no great loss. From a TPW tipster:

Two practice groups left: '40 act team (3-4 lawyers) and Latin America team (along with entire Mexico City Office). Word is the latter were loss leaders and were cut loose. Both went to join Am Law 100 firms.

A three month cushion is a boon. Come the end of June the most one can expect is a friendly firm wide email announcing your departure "to pursue other options" and a swift kick in the arse.

Ladies and gents the days of milk and honey are behind us. Keep your head down and your hours up and maybe you too will be spared.

So what do you do when you only bill 100hrs a month? Go home?

You click refresh repeatedly at abovethelaw to see how long it takes for gossip/truth to hit the wires.

You can't just go home...because (1) it's possible that a partner might stroll down the hall with an assignment and you want to be there just in case and (2) you don't want your fact of being slow SO OBVIOUS to everyone by you being gone and (3) if you are gone, it can be inferred you are lazy and not REALLY TRYING to get more work and (4) there's always "something" you can do (e.g. create useless "client development/business development plans" or read up in your area of law or...whatever)...the point is that not having enough work and still having that billable hour requirement out there is like dying a slow death. The BEST that can happen is that after you've spent workday afternoons just SITTING there trying not to be noticed, then a huge case does come and now you're sacrificing your every weekend and evening to get enough hours just to make the minimums for the year. One more reason the law firm model sucks for the junior associate.

Maybe Paul T. should have accepted those merger offers from 2-4 years ago. He could have been the Steve Case of the law firm world.

omg where did the mexico city office jump ship to? my firm has been looking to launch in mexico df. for a long time now!

What will be the fate of 2L summers at all these big firms that seem to be firing people? Is the bad PR really enough to make them extend offers?

This is what TPW gets for being honest with Lat. Every silly, unsubstantiated rumor is posted. No wonder they don't want to talk anymore. Seriously, you should have some kind of anonymous source policy before you post this garbage.

everything that has been posted here so far is true, and some of the more extreme stuff isn't even posted. nothing that is posted is even the least bit controversial unless you note that it flies in the face of the latest TPW spin/lie.

if anything, the posters are being kind in not revealing the whole story of the latest round.

Oh, unless you are going as a summer to Mayer Brown, CWT or TPW, or certain market-specific outposts like the big firm offices in Charlotte.

Then you're just screwed and should shine up your resume in your summer office.

Lat Am group went to Chadbourne

Latin Am group / Mexico City office were not asked to leave. TPW begged them to stay. TPW is spinning that now as a positive to the internal ranks- what's left of them.

Look at the facts from the past few months -

50+ associates ... laid off
Mexico City office ... left for Chadbourne
NY Latin Am practice ... left for Chadbourne
'40 Act practice ... left for Bingham
Bank reg practice ... left for Paul Hastings
White Plains office ... being shut down

Chadbourne scooped up a reinsurance team from CWT as well. It looks like there might be some winners in this economy.

TPW partners get what they deserve. After 5 years of an expansion market and they were still hiring beyond firm needs only 2 months before letting people go. Paul T. talked the talk but he could not walk the walk. It's like investing, when you put all of your eggs into one basket, you're going to get burned eventually...TPW=BURNED!!!
