A Charney v. S&C Postscript: Congratulations to Gera Grinberg!

Gera Grinberg Grade 11 Abovethelaw Above the Law blog.jpgIf Aaron Charney v. Sullivan & Cromwell ever gets turned into a movie, there will be a little epilogue at the end, to inform viewers of the fates of the dramatis personae. Here is our version of it.

Aaron Charney is believed to be happy, spending time with friends, and presumably enjoying those settlement proceeds. No word yet on his future employer (assuming he returns to the work force). Meanwhile, his erstwhile nemesis, partner Eric Krautheimer, passed the California bar and moved out to Los Angeles. He still works for S&C, but now gets to lead more of his own deals.

And what about Gera Grinberg, the former S&C associate who would have been a key witness in the case, who was joined at the hip — professionally, but not personally — with Aaron Charney? We’ve learned two pieces of good news about him:

First, he has landed himself a new job. We understand that he is now the general counsel to a small real estate development company.

Second, on the personal front, here’s some news that will put to rest any and all the rumors that he might be gay. Gera Grinberg is engaged (to a woman). His fiancee is a former associate at Kirkland & Ellis in New York, now working in-house for a large hotel company.

Congratulations and best wishes to Gera Grinberg and the future Mrs. Grinberg!

P.S. We still don’t know whether he has resolved any of his outstanding issues with S&C. But considering how well Grinberg’s life is going right now, both professionally and personally, maybe he should just let bygones be bygones?

Brokeback Lawfirm: The Sequel?

Earlier this month, it was reported that Heath Ledger is in talks to appear in a sequel to Brokeback Mountain. From Defamer:

As shattering as that moment was, however, something called for a coda — perhaps just a brief shot of a smiling Ennis, finally at peace, serving daiquiris to vacationing tourists at the Key West bed n’ breakfast he opened after Jack Twist’s death.

We may not have to rely on our imaginations for that kind of closure, however, as OK! Magazine reports that a Brokeback sequel is on the way.

Is life imitating art? Aaron Charney and Sullivan & Cromwell have just settled the litigation between them. But a sequel to Brokeback Lawfirm may be in the works.

Gera Grinberg H Rodgin Cohen Sullivan Cromwell Above the Law blog.jpgRemember Gera Grinberg — the former S&C associate who worked closely with Aaron Charney, was rumored (incorrectly) to be Charney’s gay lover, and left the firm under mysterious circumstances? A reliable source — we use the source “reliable” intentionally, since all ATL sources should be presumed unreliable, unless otherwise indicated — tells us a lawsuit by Grinberg against S&C is a distinct possibility.

This source informs us that Gera Grinberg has filed “numerous complaints with S&C,” which have not yet been resolved. The former M&A associate hasn’t heard back from them regarding the results of any investigation that they may — or may not — have undertaken. In terms of pursuing further action against the firm, Grinberg has ruled nothing out.

Very interesting. Stay tuned.

Finally, in happier news for S&C, the firm just announced the election of its new partners. The timing, in the same week as settlement of the Charney litigation, is fitting. The firm is turning a new page in its history.

Brokeback Lawfirm: Happy Birthday, Gera Grinberg

Aaron Charney ROB TV screencap.jpgAre you wondering what’s going on in the case of Aaron Charney v. Sullivan & Cromwell? You’re not alone.

We went to check the case’s status on the electronic docket, but couldn’t find the case by party name or by index number (Charney v. Sullivan & Cromwell LLP: 100625/2007; Sullivan & Cromwell LLP v. Charney: 600333/2007). This caused us to wonder: Has the litigation been settled?

Apparently not. Sources close to the case tell us that it hasn’t been settled and that there was a court hearing not too long ago. We don’t have more details, but if we get them, we’ll pass them along.

So what can we tell you?

1. S&C Man of Mystery Gera Grinberg — perhaps the critical witness in this case, who left the firm under mysterious circumstances — had his birthday last month. A reader pointed us to his attorney registration information on the New York courts website.

This tipster also noted that Grinberg’s attorney registration status was recently updated, but does not list an employer. This suggests he has not yet found new employment since leaving 125 Broad Street. Does anyone know where he might be?

2. Could the Charney case be affecting S&C’s recruiting this year? Possibly. We reprint an interesting tip, suggesting that it’s affecting the firm’s reputation, after the jump.

Brokeback Lawfirm: A Portrait of Gera Grinberg As A Young Man

Sullivan & Cromwell, the salacious case filed by former S&C associate Aaron Charney (at right), alleging anti-gay discrimination and retaliation by his extremely prestigious (and profitable) former firm. But for those of you who are interested in this matter, today we have a special treat.

Remember Gera Grinberg — the former colleague of Aaron Charney who some partners suspected was in an “unnatural relationship” with Charney? Grinberg, who no longer works at S&C, is a critical figure in this case. But he has been an elusive figure to followers of this litigation. We’ve seen no pictures, and we know few facts about him.

Finally, after months of mystery, we’ve gotten our hands on a photograph of him. It’s kinda old, but hey, it’s better than nothing.

Brokeback Lawfirm: ‘Slew of Activity’ Last Friday

Aaron Charney.jpgLEWW is ashamed to admit that we have not followed the Charney versus Sullivan & Cromwell lawsuit with the attention it so richly deserves. Fortunately, there are other bloggers who’ve got you (and us) covered regarding coverage and analysis of this complex affair in Lat’s absence.

Keeping Up With Jonas has a nice capsule summary of the three orders issued by Judge Fried in the matter yesterday, with links to the orders.

And Professor Art Leonard has this more detailed write-up.

Judge Fried denied without explanation a motion by Gera Grinberg’s attorney to have Grinberg’s deposition transcripts unsealed. Writes Leonard:

Attorney Grinberg worked closely with Aaron Charney as a fellow associate at S&C on a variety of client matters, and their close working relationship seems to have sparked the incidents upon which Charney bases his lawsuit. Grinberg was present at the meeting between Charney and S&C partners Vince DiBlasi and David Braff on January 31, the day before S&C discharged and sued Charney.

There is considerable dispute between Charney and S&C about what was said at that meeting, with Charney claiming that the only written record, which would back up his account, was made by Grinberg, who then turned his notes over to his attorney at that time for safekeeping. Charney has alleged that the Grinberg notes were improperly destroyed as part of a conspiracy between S&C and Edward Gallion, a lawyer S&C had retained to represent Grinberg. Amidst the skirmishing over motions to dismiss, Grinberg submitted to a deposition focused on what occurred at that meeting, but the transcript of the deposition has been sealed, and S&C’s lawyers criticized Charney for relying on and referring to that testimony in his amended complaint.

Leonard also reports that Grinberg, who was placed on paid leave by S&C, is no longer listed on the firm website.

Brokeback Lawfirm: Back in the Saddle

Some background about the new complaint, from an article by Anthony Lin in this morning’s New York Law Journal:

Manhattan Supreme Court Justice Bernard Fried dismissed Charney’s original pro se complaint without prejudice earlier this month, ruling that some of the ex-associate’s allegations and attachments were irrelevant and potentially violative of disciplinary rules. The judge gave Charney leave to replead his case.

Though Charney, now represented by four lawyers, excised the material cited by the judge, he added new allegations concerning events that took place after his initial complaint was filed, in particular a Jan. 31, 2007, settlement meeting.

Brokeback Lawfirm: Sorry, We Got Nothin’

Aaron Charney headshot Aaron B Charney Aaron Brett Charney.JPGMany of you have expressed interest in the latest developments in the continuing litigation between gay lawyer Aaron Charney and his former employer, Sullivan & Cromwell. It has been quite some time since our last post about this case.

Unfortunately, as far as we know, nothing is going on right now. We have a Google Alert set to notify us of all things Charneylicious, and it has been silent lately. This morning we checked the docket, as well as the blogs of two top Charney watchers, Professor Art Leonard and Lavi Soloway. Nada, zilch, zip.

To tide you over, here is one little rumor (unconfirmed, so take it with a grain of salt). It’s so minor that we hesitate to share it. But, for what it’s worth, we hear that Gera Grinberg — the S&C associate who had a relationship with Aaron Charney that partner Alexandra Korry allegedly described as “unnatural” — is back in the office.

(We tried to confirm this by emailing Grinberg. We didn’t receive a response; but we also didn’t receive an “Out of Office” notice, either.)

Observers of this case will recall that Gera Grinberg was placed on a leave of indefinite length by S&C, shortly after the lawsuit was filed. He was on this delightful vacation paid leave for a period of at least several weeks. But now we hear that he’s back at 125 Broad Street, working away like a good corporate lawyer.

Boy that must be awkward — for both Grinberg and S&C. After all, Grinberg is at the center of some salacious allegations about possible misconduct in this case.

Brokeback Lawfirm: Highlights from Aaron Charney’s Deposition

Brokeback Lawfirm: It Gets Better By the Day

Brokeback Lawfirm: An Insider’s View (Part 1)

Sullivan & Cromwell. Some of this information has previously appeared elsewhere, but this letter nicely synthesizes everything.

It’s long, so we’ll post it in two parts. Here’s the first installment:

While I’ve hesitated until now to write, your coverage of Aaron Charney’s lawsuit has been extremely entertaining, if often wildly inaccurate.

Like many current and former associates at S&C, I’m torn between my indifference towards Aaron (who was standoffish at best and somewhat obnoxious at worst) and my recognition of some genuinely negative aspects of the firm as portrayed in his complaint. But ultimately I have to come down on the side of the firm, because from where I sit Aaron’s story — while it may be peppered with, or “larded”, with some actual facts — doesn’t really paint a picture of discrimination or retaliation.

First of all, I think the idea of S&C being anti-gay as an institution is completely laughable. I’ve even heard fellow associates express concern that — all other things being equal — being straight is a liability when it comes to making partner. I’ve never heard a homophobic, racist or sexist comment, although I’ve heard rumors of a few. It’s rumored as well that Aaron himself made a homophobic comment or two in his more deeply closeted days. Who knows. Maybe I just inspire caution in this regard.

Brokeback Lawfirm: Five Facts About Gera Grinberg

Gera Grinberg Above the Law Sullivan Cromwell Gera Grinberg Aaron Charney Above the Law.JPGWe previously issued a request for any and all information, however trivial, about Gera Grinberg — the mysterious Sullivan & Cromwell associate who worked closely with Aaron Charney, plaintiff in Charney v. S&C. We received a few responses.

The tidbits we received are rather insignificant. But considering how secretive Gera Grinberg appears to be — neither we nor the many MSM reporters on the scene have managed to dig up anything major on him — we regard these factoids as a minor coup.

The answer to the question “What’s Gera Grinberg really like?” is a more closely guarded secret than the identity of Valerie Plame. Okay, bad example; but you get the point. Anyway, here are our five factoids:

1. People who have worked with Gera Grinberg describe him as “a nice guy.” Normally this wouldn’t be worth mentioning. But considering the high a**hole quotient in S&C’s M&A group, it’s significant.

2. Gera lives in a luxury apartment development in Jersey City’s Hudson River waterfront district — a relatively easy commute to S&C’s downtown offices.

3. Grinberg went to school in Canada — Kwantlen University College in British Columbia, followed by the University of British Columbia Faculty of Law — but he was born in Eastern Europe (Ukraine, upon information and belief).

4. Gera is heterosexual, and he has — or at least he had (we don’t know the current status of the relationship) — a girlfriend. Said girlfriend is also a lawyer; we don’t know where she works.

5. As far as we know, Gera Grinberg is still on paid leave from Sullivan & Cromwell — and apparently remains on the payroll, since he’s still on the S&C website.

(Recall that when Aaron Charney was finally fired by S&C, well after he filed his pro se lawsuit, his bio was removed from the firm website faster than Alexandra Korry can hurl a stapler.)

Are these earth-shattering revelations? Hardly. But considering Gera Grinberg’s status as International Man of Mystery, we deserve credit for unearthing even these measly scraps.

Brokeback Lawfirm: A Status Conference Tomorrow

It looks like there’s going to be a status conference tomorrow in Sullivan & Cromwell v. Charney. Here’s the docket entry:

Unfortunately, we won’t be able to travel up to New York for the festivities. If you work at 60 Centre Street or nearby, and might be able to attend the proceedings, we’d be most grateful for your report.

In other Brokeback Lawfirm developments, Lavi Soloway has gotten his hands on a copy of the transcript from the last Charney v. S&C hearing. He parses it in this post. Here’s a highlight:

THE COURT: That’s a settlement meeting between Mr. Charney and persons respresenting Sullivan & Cromwell?

MR. ALTERMAN: Sullivan & Cromwell themselves before we were involved.

THE COURT: With Mr. Charney?

MR. ALTERMAN: With Mr. Charney and another witness.

THE COURT: That’s my question.

MR. ALTERMAN: And another witness represented by counsel, a secret settlement meeting when they offered him a sum of money.

Lavi Soloway wonders: “Who was the other witness? Was it Gera Grinberg, represented by Gallion & Spielvogel?

Discussion about the “secret settlement talks” reminds us — we’ve been meaning to pat ourselves on the back. On February 2, we feverishly speculated that settlement discussions were ongoing between the parties.

When S&C’s lawsuit against Charney became widely known, it looked like we were wrong. But as it turns out, we were right, at least in part. The parties WERE in the process of trying to settle the case during the second half of that week. It wasn’t until after the talks failed, and Charney found counsel for himself, that the parties wound up at 60 Centre Street (first for a TRO hearing before Justice Charles Ramos, and then for later proceedings before Justice Bernard Fried).

Brokeback Lawfirm: Gera Grinberg — Who Is This Guy?

Anna Schneider-Mayerson, always an expert at digging up fascinating facts, has outdone herself this time. To read the entire piece, click here.

Here are some highlights that caught our attention. On the early settlement discussions:

According to a source familiar with Sullivan & Cromwell’s side of the litigation, Mr. Charney initially asked for $5 million, and Sullivan & Cromwell offered “a very small fraction” of that. Mr. Charney referred calls to his lawyers, and through its recently retained public-relations firm, Sullivan & Cromwell declined to comment.

On S&C’s countersuit:

“The debate was: ‘Would this help us or hurt us?’” said the source familiar with Sullivan & Cromwell’s legal strategy. “The downside in filing the suit was to prolong the story, to keep it on the front pages …. [But] we concluded that we were obligated to bring the lawsuit irrespective of what it did to us.”

On Sullivan & Cromwell’s latest filing, a motion to dismiss (which we’d love a copy of if anyone can send it to us):

On Feb. 13, Sullivan called on the judge to dismiss Mr. Charney’s complaint on the grounds that the case will reveal client and firm matters and secrets. In a footnote to the 22-page motion, the lawyers address Mr. Charney’s destruction of his hard drive with a snarl.

“Charney’s attempt to blame S&C for his willful destruction of material information in violation of the New York Penal Code is false, contemptible and will be addressed at the appropriate time,” the note reads.

And, finally, on Aaron Charney’s ex-associate and friend, Gera Grinberg:

In his complaint, Mr. Charney claimed, he was told that a Sullivan partner referred to their friendship as “unnatural” and that another partner thought they were too close. (That Sullivan associate, Gera Grinberg, has since been placed on paid leave.)

Gera Grinberg is a central figure in the Brokeback Lawfirm saga. He’s Ennis Del Mar to Aaron Charney’s Jack Twist.

(We’re making Gera the more butch one because he’s reportedly straight. Also, based on this comment and this one, it seems that Aaron Charney was basically Gera Grinberg’s bitch.)

But unlike the other figures in this story — Eric Krautheimer, Alexandra Korry, David Braff, etc. — we know so little about Gera Grinberg. Heck, we can’t even find a photograph of the guy.

We’d like that to change. We hereby request any and all information and rumor you might have about Gera Grinberg — what he was like in law school, what he was like to work with at S&C, baby pictures, etc. Please send what you have to us by email. Thanks!

P.S. Yes, we have contacted Grinberg’s staggeringly prestigious lawyers, Gallion & Spielvogel, for confirmation that he is now on paid leave. But we don’t expect to hear back from them, since they’ve ignored most of our prior inquiries.
